Texas counseling boundaries
Texas Occupations Code §503.003 defines professional counseling broadly, and §503.301 requires a license or a statutory exemption to practice it. Calling a service “coaching,” obtaining a client’s consent, or partnering with a nonprofit does not by itself authorize regulated counseling. Perspect’s policy excludes clinical services; coaches must stay within nonclinical activities and must not imply clinical licensure.
Privacy and reporting
Federal HIPAA applies to covered entities and business associates as defined by law, not every coaching business. Texas medical-record privacy obligations under Chapter 181 can be broader and depend on actual activities and information handled. Texas Chapter 611 concerns qualifying mental health professionals and patient records; it does not automatically create clinical privilege for a coach. Applicable abuse-reporting duties and lawful emergency disclosures can override ordinary privacy choices.
Location and limits of this guide
Rules may also depend on where a member and coach are physically located during a session. Coaches must not provide services prohibited by either applicable jurisdiction.
